Welcome to SpellIt∞. These Terms are the agreement between you and SpellIt∞ ("we", "us") for using our word game, both the web app and the native mobile apps. By playing, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the game.
1. Who can play
You may play solo at any age. To use online multiplayer, chat, and other social features we ask for your birth year. Accounts are for players 13 and over: a player under 13 cannot create one, and that device plays offline, where pass and play needs no account at all. Players aged 13 to 15 need a parent or guardian to approve online access by email, and a guardian can review, limit, or turn off that access at any time. By using the game you confirm the information you give us is accurate and that you have the right to agree to these Terms (or that your guardian has agreed for you).
2. Your account
You can play as an anonymous guest or verify an account by email or by signing in with Google, Apple, or Microsoft. You're responsible for activity under your account and for keeping your sign-in secure. Don't share your account, impersonate others, or create accounts to evade a block or suspension. Guest progress may be lost if its anonymous session lapses; verify an account to keep your progress.
3. Playing fair: acceptable use
SpellIt∞ is meant to be welcoming. You agree not to:
- Harass, threaten, bully, or hate on other players; post sexual, violent, or otherwise objectionable content.
- Cheat, automate play, exploit bugs, or use tools that give an unfair advantage.
- Disrupt the service, attempt to breach security, or access data that isn't yours.
- Break the law, infringe others' rights, or post spam or scams.
- Reverse-engineer, resell, or commercially exploit the game except as these Terms allow.
We may remove content and suspend or terminate accounts that break these rules.
4. Content you create
You keep ownership of the content you create: chat messages, board names, feedback, and profile details. You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and use that content as needed to operate and improve the game (for example, showing your moves in a board's replay). You're responsible for what you post and confirm you have the right to post it. We may remove content that violates these Terms.
5. Safety & reporting
You can mute any player for yourself, block abusive users, and report any message or board to our safety team. We review reports and may act on them, including removing content and restricting accounts. On public boards, free-typed chat is limited to keep strangers safe; richer chat is reserved for private tables and mutual friends. We aim to respond to safety reports promptly.
6. Coins, chests & virtual items
The game may include virtual items such as coins, hints, chests, and similar. These are a limited license to use in-game features only. They have no cash value, cannot be exchanged for real money, are not transferable outside the game, and are non-refundable except where the law requires. We may adjust, expire, or discontinue virtual items as we develop the game. Virtual items are not stored value, a bank product, or legal tender.
7. Tournaments & contests
Some game modes let players enter tournaments using in-game coins. These are games of skill for in-game rewards only. Entry and prizes are in virtual items with no cash value. SpellIt∞ tournaments are not gambling and offer no real-money prizes. Where a tournament has additional rules, those rules are shown before you enter.
8. Purchases
If we offer paid items or subscriptions, purchases are handled by the app store you use (Apple or Google) or another payment provider, subject to their terms. Prices and availability may change. Except where the law or the store's policy requires, purchases are final. Any real-money purchase grants virtual items under section 6; it does not buy stored value.
9. Sponsored boards, rewards & ads
Some boards are endorsed by a business or venue. On those boards you may see the sponsor's name, a welcome, links, and from time to time sponsor messages or ads. This helps keep SpellIt∞ free and supports the venues that host play. We tell you when you first join such a board. Sponsors may offer rewards (coins, badges, or real-world vouchers) for completing achievement sets, sometimes within a limited campaign window. Real-world rewards and vouchers are provided and honoured by the sponsor, subject to the sponsor's own terms; we are not responsible for them and do not endorse any sponsor's products. We do not sell your personal data to sponsors.
10. Meeting people & location
SpellIt∞ encourages friendly, real human connection, and some boards are tied to real places. Location features are opt-in. Your own position may be shown to you, on your own device, to help you find boards near you; it is never shown to other players. If you choose to meet other players in person, you do so at your own risk: use good judgment and meet in safe, public places. We are not responsible for interactions between players.
11. Our content
SpellIt∞, its name, logo, design, software, and game content are owned by us or our licensors and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the game for your own enjoyment under these Terms. All rights not expressly granted are reserved.
12. Suspension & termination
You can stop playing at any time and delete your account from within the app. We may suspend or terminate access if you break these Terms, to protect players or the service, or if required by law. Some provisions, including ownership, disclaimers, and limits of liability, survive termination.
13. The game is provided "as is"
We work hard to keep SpellIt∞ running well, but the game is provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We don't guarantee the game will always be available, uninterrupted, or error-free, and we may change, suspend, or discontinue features.
14. Limitation of liability
To the fullest extent permitted by law, SpellIt∞ is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of the game. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by our negligence, or fraud).
15. Indemnity
You agree to reimburse us for reasonable losses and costs arising from your misuse of the game or your breach of these Terms or the law, to the extent the law allows.
16. Changes to these Terms
We may update these Terms as the game evolves and will change the effective date above. For material changes we'll give in-app notice. Continuing to play after an update means you accept the revised Terms.
17. Governing law
These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws rules, and you and we submit to the courts located there, unless a mandatory consumer-protection law in your country of residence provides otherwise.
18. Resolving disputes
Talk to us first. Most problems are settled quickly by email. Before starting any formal proceeding, send a written description of the dispute and what you want to spellitsupport@codefromhome.com and give us 60 days to resolve it. We will do the same before bringing any claim against you. This is a requirement rather than a courtesy, and either of us may ask a court to enforce it.
Small claims. Either of us may instead bring an individual claim in small claims court, if it qualifies. Nothing here prevents that.
No class actions. Claims are brought only in an individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative proceeding. If this paragraph is held unenforceable as to a particular claim, that claim, and only that claim, is severed from this section and proceeds in court.
Time limit. Any claim must be brought within one year of when it arose, to the extent the law where you live allows a limit of that length.
Where you live in a country whose mandatory consumer-protection law says otherwise, that law wins over this section, the same as in section 17.
19. If you got the game from Apple's App Store
This section applies only to copies obtained through Apple's App Store, and where it conflicts with anything above, this section controls.
These Terms are between you and us only, not with Apple, and we, not Apple, are solely responsible for the game and its content. Your licence to use the game on Apple-branded devices is limited by the usage rules in Apple's App Store Terms of Service. Apple has no obligation to provide maintenance or support for the game.
If the game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our responsibility.
We, not Apple, are responsible for addressing your claims or any third party's claims relating to the game, including product liability, failure to conform to legal requirements, and consumer-protection claims, and for investigating, defending, settling, and discharging any third-party claim that the game infringes intellectual property rights.
You confirm that you are not located in a country subject to a US Government embargo or designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
